Prosecutors dismiss charges against deaf man tased by Phoenix officers

PHOENIX (AZFamily) — The Maricopa County Attorney’s Office announced on Thursday that all charges are being dismissed in the case against Tyron McAlpin, who appeared to be hit multiple times and tased by Phoenix Police officers during an arrest in August.

McAlpin, who is deaf and has cerebral palsy, faced multiple felonies as he was accused of assaulting someone, aggravated assault on police officers and resisting arrest.

Body-camera video footage obtained by Arizona’s Family and other outlets showed how the incident unfolded, which immediately drew criticism from community activists, including the NAACP.

“I promised I would personally review the case including a large volume of video recordings, police reports, and other materials that have been forwarded to my office,” Maricopa County Attorney Rachel Michell said in a written statement. “On Tuesday of this week, I also convened a large gathering of senior attorneys and members of the community to hear their opinions as they pertain to this case. I have now completed my review and have made the decision to dismiss all remaining charges against Mr. McAlpin.”

In the body-worn footage, an officer is seen immediately going after McAlpin. A nearby security camera shows the officer driving in front of him while he’s walking before the officer engages him.

According to the police report, that is when McAlpin fought back against officers. Another officer arrived on the scene, but his body camera flew off during the incident.

The police report revealed that officers were investigating an assault at a nearby Circle K and that McAlpin fit the description of the suspect.

Last week, the Phoenix Law Enforcement Association sided with the officers in question, adding the media had “biased reporting.”

In a new statement Thursday, the police union called Mitchell’s decision “appalling,” and said the case was an “ugly smear campaign” against Phoenix Police.
