ATLANTA — Attorneys for Donald Trump asked a Georgia appellate court Wednesday to consider the “unconstitutionality” of the ongoing 2020 election interference case against him now that he is the nation’s president-elect and order the presiding judge to dismiss all charges against him.
The motion asks the Georgia Court of Appeals to find that it no longer has legal jurisdiction over the matter because it is unconstitutional to prosecute a sitting president “in any way.” It also asks the appellate court to order Fulton County Superior Court Judge Scott McAfee, who is presiding over the criminal racketeering and conspiracy case, to dismiss the indictment against Trump.
